Thanks to the Internet, you no longer have to rely on local radio stations to listen to music you like, and you don’t have to worry about albums being out of stock at the local record store. You have access to a much wider selection of music, and you can listen to radio stations that are programmed according to your tastes.

Besides benefiting consumers, the Digital Music Revolution also gives musicians more control over their music. Thanks to MP3 and the Internet, bands that don’t have contracts with a record company now have access to a worldwide distribution channel that offers them a much higher profit potential. With Internet distribution, much of the overhead disappears. In fact, Internet record labels typically offer royalties of 50%, compared to the 12%-15% typically offered by the major labels.

The economics of Internet music distribution are so compelling that even major artists are choosing to distribute their music through the Internet. Some bands are going a step further and setting up Web sites to sell music and merchandise directly to their fans. Even if only a small percentage of their fans are online, this approach can generate much greater profits because the costs are so low.

A key factor early in this revolution was the development of Winamp, a popular program for playing digital audio on PCs. Winamp was the first full-featured program for playing music in MP3 format. Winamp was developed by Justin Frankel in April 1997, shortly after he dropped out of the University of Utah. Winamp quickly surpassed other players in popularity because of its advanced features like equalizer presets and support for third party plug-ins and skins. In June 1999, Justin’s company, Nullsoft, was acquired by America Online (AOL) for approximately $80 million in stock—not bad for a 20-year-old.

The spark that made the revolution front-page news was the lawsuit filed by the RIAA (Recording Industry Association of America) and the AARC (Alliance of Artists and Recording Companies) to prevent Diamond Multimedia from selling its Rio portable MP3 player. Before the Rio, MP3 users were limited to listening to MP3 files on their computers. But the Rio provided a way to make MP3 portable and, therefore, more appealing to mainstream consumers. Suddenly, MP3 was a serious threat to the recording industry, which had previously not paid much attention to it.

The RIAA is concerned about MP3 because its small file size and lack of security measures make it easy for people to illegally reproduce and distribute copyrighted music. College students with fast Internet connections quickly found out that with MP3 they could download hundreds of songs in less time than it would take to make a trip to the local record store. This kind of piracy is difficult to prevent because the music is just digital bits, and not physical media like tapes and CDs. On the Internet, a single copy of a file can grow to thousands of copies in minutes.

The RIAA argued that the Rio was a digital recording device covered by the Audio Home Recording Act of 1992. A provision of this law requires consumer digital recording devices to incorporate the Serial Copy Management System (SCMS), to prevent the proliferation of multiple generations of digital copies. The RIAA also maintained that the Rio was used primarily to play pirated music downloaded from the Internet.

In June 1999, the U.S. Court of Appeals ruled unanimously in favor of Diamond Multimedia, accepting its argument that the Rio was a computer peripheral and not subject to the SCMS requirement. The court also ruled that the Doctrine of Fair Use (see Chapter 5) allows consumers to “space-shift” music by copying it to another device, similar to their right to “time-shift” video recordings. The right to time-shift was established in the case of Sony versus Universal City Studios in 1984 (464 U.S. 417), which concerned the sale of videocassette recorders in the United States.

Diamond Multimedia not only won the lawsuit; they also received massive amounts of free publicity, which helped increase the demand for the Rio to the point where they were producing more than 10,000 of them per week. The ruling in favor of Diamond Multimedia was also a victory for consumers and consumer electronics manufacturers. But the battle over consumer’s fair use rights is far from over, and will likely require further legislation.

                                               Vision of a Pop Star
MUSIC: I am creating a fresh sound that has movement in it! Innocence and joy are key elements of
the music that represents J Michael Lucas. I am always moving and so even my slower tempo songs
have rhythm and flow to them. There are sounds and instruments and often my own ‘beat box’ vocals
added to keep the songs interesting and always developing and current.
I am involved in writing each song, including the lyrics and in analyzing the great pop songs of the past
I believe that elements in the song, combined with catchy lyrics drives the song. This is what I strive to
achieve. The lyric has a straight forward and direct voice with the beat, percussion elements, synth and
melody combining to give an immediate and memorable hook.
The songs come from my life experience. My focus is not bling, or casual sex or shock value but the
memorable moments and interactions in life that are then elevated to an artistic and musical level to
create pop hits that have a classic foundation with today’s beats and sounds. I am a very spiritual
person and so there are spiritual elements woven into the overall tapestry of my music. When you
study the greats such as Michael Jackson, Elvis Presley and the Beatles you also find this spirituality
woven into their music. This I aim to achieve with my music as well. My songs speak about
relationships and romance, as well as hopes and dreams, but without resorting to overt sexual and
blatant ‘bling’ references. That’s not J Michael Lucas!
DANCE: I am a dancer. I express through my body as well as my voice and songs. This is a vital
part of who J Michael Lucas is as a pop artist. My first and primary influence is Michael
Jackson. From the time I was a young boy I fell in love with his music and performances through his
music videos and TV appearances. I began to train as a dancer but always worked on my Michael
Jackson moves on my own. I have studied and attended workshops with many great choreographers
and have developed my own dance style, but Michael’s work is like a classic foundation for
me. Although I am developing original moves and unique steps there is an intensity and commitment
that I bring to my dancing that I learned from Michael. That was his gift to me. When you study the
young Elvis you also witness this special energy that he brings to his movement and performances that
is very similar to Michael. These are the pop stars that I emulate!
IMAGE: I am very comfortable with my look and physical appearance. I am not interested in
having surgery or creating ‘costume art’ as many of the current female artists strive for. I bring a level
of intensity and movement to my performances that demands that my clothing moves with me and
allows freedom. I am influenced by the fashion sense of OutKast, Justin Timberlake and the young
Elvis. Bold colors, suspenders, hats, fitted jackets a bit of sparkle and the J Michael Lucas look
emerges!
MISSION: I want to make it real and keep it real. This requires staying true to myself, to my
experiences, my music sense with a strong beat that demands movement. I work to create songs and
performances that will inspire and motivate the young audiences of today while at the same time
catching their imaginations and entertaining at the same time. I want to present an image of innocence
mixed with sophistication that will appeal without resorting to negative behavior. I want to lift the
spirit of those who witness my shows and music videos and subtly inspire them to greatness.

It's hard to believe it's been a year since Michael Jackson died.
If you never got to see him live on stage, you still have a chance to get the Michael Jackson experience.

30-year old J Lucas is a singer and songwriter with a gift of dance, who's living the legend in Branson.

"I am from a small town, Aiken South Carolina.  Michael's cheek bones were very skinny, because he had such a skinny face, so I'm just going to put this bronzer on my cheeks.  Someone from my small town said, hey, have you ever heard of Legends in Concert?  I said, yeah, I've heard of it.  He said you really ought to think about auditioning because you're good at what you do as Michael Jackson.  I never thought anything of it, you know.  

I started liking Michael when I was about four, four or five years old.  The first time I saw the Thriller video I was just, I thought it was just the coolest thing ever.  My mother went out the next day and found a red leather jacket, bought me silver socks, bought me a plastic microphone.  What do you want me to say?  I really love working here.  That good?  Nice.  

It tore me to pieces when Michael died.  It really did.  I felt like I'd lost my best friend.  Sometimes I get on my phone, type in a You Tube video and watch before I go on stage.  Socks... push it down like so.  

Okay, step on in next to Michael for a photo.  Hi!  Have a great time.  Enjoy the show.  Nobody had that charisma, that intensity that Michael had.  That attitude, that makes you like... ahhhh.  
Ladies and Gentlemen, please welcome the king of pop Michael Jackson.  One, two, three... jam.  Jam.  Jam.  Jam.  When I'm here for Legends and I get in that costume, I try to transform myself into Michael Jackson for the time.  That's what the people came to see that's what they want to see.  I hope I'm doing my very best to make Michael proud."

J Lucas also performs along with brandson tribute performers Elvis, Little Richard, Alan Jackson, Britney Spears and The Blues Brothers in "Legends In Concert" on most dates through out the year starting in September.

In a special tribute show on Friday, a local Branson dance group, "Dance Branson" will join Lucas and the cast on stage for "Thriller."

Also, hundreds of Michael Jackson's personal items are up for auction this weekend.  They are part of Julien's Auctions summer sale.  It starts today in Las Vegas.  One of Jackson's signature gloves is expected to bring up to $30,000.  
"Clothing items, items related to his career tend to sell for the most," explain Darren Julien.  "So we have several really key pieces. We have a shirt that he wore in the "Beat It" video. We have the wedding jacket when he married Debbie Rowe. So any number of one of these things could sell for a lot of money."
